SECTIONS 2 OF MMC ORDINANCE NO. 78-04 AND
MMA ORDINANCE NO. 5, SERIES OF 1994
RE: TRUCK BAN
WHEREAS, in accordance with pertinent provisions and Implementing Rules and Regulations of RA 4136, otherwise known as the Land Transportation Act of the Philippines, the term "cargo trucks" refers to vehicles having a gross capacity weight of over 4,500 kilograms which differs from the definition under the MMDA Truck Ban Regulations which provide that cargo trucks are vehicles having a gross capacity weight of over 4,000 kilograms;
WHEREAS, there is a need to harmonize the discrepancy in the definition of cargo trucks to attain uniformity in the enforcement of pertinent traffic rules and regulations.
NOW THEREFORE, pursuant to Section 6 of RA 7924, this Regulation is hereby promulgated and adopted by the Metro Manila Council, that:
SECTION 1. Definition of Cargo Trucks - Sections 2 of MMC Ordinance No. 78-04 and MMA Ordinance No. 5, Series of 1994, is hereby amended, and as so amended, shall now read in full, as follows:
"Sec.
2. Definition of Cargo Trucks. The term "cargo trucks" shall be understood
to mean motor vehicles principally intended for carrying cargo and having license
plates of the following classifications: "S", "T", "TC",
"TH", "TRLB", "HHB", and "TRJ", to include
other vehicles such as lorries, vans, tankers, or other delivery vehicles, whether
loaded or empty, having a gross capacity weight of more than 4,500 kilograms."
SECTION 2. This Regulation shall take effect fifteen (15) days after its publication
in two (2) newspapers of general circulation.

MMDA REGULATION NO. 96-008
AMENDING MMA ORDINANCE NO. 5, SERIES OF 1994 ENTITLED FURTHER AMENDING MMC ORDINANCE
NO. 78-04, AS AMENDED BY MMA ORDINANCE NO. 19, S. 1991 RE: TRUCK BAN
WHEREAS, it has been observed that a critical situation of traffic congestion
still exist during Saturdays inspite of the implementation of the United Vehicular
Volume Reduction Program under MMDA Regulation No. 96-005;
WHEREAS, the Metro Manila Council in its desire to further reduce or minimize traffic congestion even on Saturdays, agreed to amend MMC Ordinance No. 5, Series of 1994;
NOW THEREFORE, pursuant to Section 6 of RA 7924, the first paragraph of Section 1 of MMA Ordinance No. 5, series of 1994 is hereby amended to read as follows:
“Section 1. No cargo truck shall be allowed to travel or pass along the roads/streets or thoroughfares enumerated under the second paragraph, Section 1 of MMA Ordinance No. 5, series of 1994 from Monday to Saturday except Sundays and Holidays.”

FURTHER AMENDING MMC ORDINANCE NO. 78-04, AS AMENDED BY MMA ORDINANCE NO. 19, S. 1991 RE: TRUCK BAN
WHEREAS, the continued increase in the number of vehicles plying the major thoroughfares
in Metro Manila has resulted to more traffic congestion;
WHEREAS, the Confederation of Truckers Association of the Philippines takes cognizance of the problem and has, in fact, conveyed willingness to extend support in solving the traffic problem of the metropolis;
WHEREAS, in its desire to decongest and solve the traffic problem in Metro Manila, the Metro Manila Land Transportation Coordinating Council (MMLTCC) issued Resolution No. 94-002 providing for new truck ban hours and total daytime truck ban along EDSA;
WHEREAS, the Metropolitan Manila Council (Council), after due deliberation and in session duly assembled, finds the aforesaid MMLTCC No. 94-002 meritorious.
NOW, THEREFORE, be it ordained by the Metropolitan Manila Council, pursuant to Executive Order No. 392, series of 1990, that:
SECTION 1. Coverage - Section 1 of MMC Ordinance No. 78-04, as amended by MA Ordinance No. 19, s. 1991, is hereby further amended, and as so amended, shall now read in full, as follows:
Section I - From 6:00 A.M. to 9:00 A.M. and from 5:00 P.M. to 9:00
P.M. everyday except Saturdays, Sundays and Holidays, no cargo truck shall be
allowed to travel or pass along:
(1) España Street through Quezon Avenue; from Echague Street to the intersection of West and South Avenues; (2) Claro M. Recto Avenue from Legarda Street to del Pan Street; (3) President Quirino Avenue from south Superhighway to Roxas Boulevard; (4) P. Burgos Street through Ayala Boulevard, Legarda Street, Magsaysay Boulevard and Aurora Boulevard, from Roxas Boulevard to Boston Street; (5) E. Rodriguez Avenue through Bonifacio Avenue from Welcome Rotonda to Shoe Avenue; (6) South Superhighway through Nagtahan Bridge and Alfonso Mendoza Street from Epifanio delos Santos Avenue to Dimasalang Street; (7) Taft Avenue through Quirino Avenue from Redemptorist Street to Plaza Lawton, to include McArthur, Quezon and Jones Bridges; (8) Bonifacio Drive through Roxas Boulevard and NAIA Road from Aduana Street to the Ninoy Aquino International Airport; (9) Rizal Avenue through Rizal Avenue Extension from Carriedo Street to the Bonifacio Monument; and (10) Reina Regente Street through Abad Santos Street from Reina Regente Bridge to Rizal Avenue Extension.
Provided that the following alternate routes leading to and from Port Area shall not be included in the ban, to wit:
a. SOUTHERN TRUCK ROUTE
From Port Area to South Superhighway
Bonifacio Drive, left P. Burgos, Finance Road, Ayala Boulevard, right San Marcelino, left Pres. Quirino, right South Superhighway.
From South Superhighway to Port Area
South Superhighway, right Pres. Quirino, left United Nations Avenue, right Romualdez Street, left Ayala, P. Burgos, right Bonifacio Drive, to Port Area.
b. NORTHERN TRUCK ROUTE
From Port Area to North Diversion Road
From Pier Zone, travelling northward along R-10, right Capulong towards Tayuman, straight ahead towards Gov. Forbes, left Maria Clara, left Dimasalang, right Blumentritt, left A. Bonifacio and find their way to the north.
From North Diversion Road to Port Area
From the north and travelling southward along A. Bonifacio Aveue, right Blumentritt, left Aurora Boulevard, right Dimasalang, right Aragon Street, right Gov. Forbes towards Tayuman and Capulong, left R-10 to the Pier Zone.
c. EASTERN TRUCK ROUTE
From Port Area to Marcos Highway
From Pier zone, travelling northward aong R-10, right Capulong towards Tayuman, straight ahead towards Gov. Forbes, left Maria Clara, cross Dimasalang, straight ahead towards Constancia, right at Constancia, left Laonglaan, straight towards D. Tuazon Avenue, right at D. Tuazon Avenue, left Quezon Boulevard Extension, straight towards Elliptical Road, take Don Mariano Marcos Avenue, left Aurora Boulevard, straight towards Marcos Highway.
From Marcos Highway to Port Area
Marcos Highway straight towards Aurora Boulevard, right at Katipunan, straight towards Tandang Sora, left Don Mariano Marcos Avenue, straight towards Elliptical Road, take Quezon Boulevard Extension, straight towards West Avenue, right West Aveneue, left Del Monte Avenue, straight towards A. Bonifacio, left A. Bonifacio Drive, right Blumentritt, left Aurora Boulevard, right Dimasalang, right Aragon Street, right Gov. Forbes towards Tayuman and Capulong, left R-10 to the Pier Zone.
Provided, further, that there shall be a total truck ban along Epifanio delos Santos Avenue (EDSA), between Pasong Tamo in Makati and Balintawak in Quezon City/Kalookan City everyday from 6:00 A.M. to 9:00 P.M. except Saturdays, Sundays and Holidays.
SECTION 2. Definition of Cargo Trucks - Section 2 of MMC Ordinance n. 78-04 shall remain in full force and effect.
SECTION 3. Violation and Penalty - Section 3 of MMC Ordinance No. 78-04 is hereby amended, and as so amended, shall now read, as follows:
“Section 3 - Any person who violates the provisions of this Ordinance shall be punished by a fine of not less than Five Hundred (P500.00) Pesos but not more than Two Thousand (P2,000.00) Pesos or by imprisonment of not less than seven (7) days nor more tan thirty (30) days, or both, at the discretion of the court”.
SECTION 4. Payment and Accrual of Fines - Section 4 of MMC Ordinance No. 78-04 shall remain in full force and effect except that the phrase “Metro Manila Commission” used therein shall now read as “Metro Manila Authority”.
SECTION 5. Implementing Rules and Regulations - Section 5 of MMC Ordinance No. 78-04 shall remain in full force and effect except that the phrase “Metro Manila Commission” used therein shall now read as “Metro Manila Authority”.
SECTION 6. Repealing Clause - Section 6 of MMC Ordinance No. 78-04, shall remain in full force and effect.
SECTION 7. Effectivity Clause - Section 7 of MMC Ordinance No. 78-04 is hereby amended, and as so amended, shall now read, as follows:
“Section 7 - Effectivity Clause - This Ordinance shall take effect ten (10) days after its publication in a newspaper of general circulation”.
