RATIFYING THE MEMORANDUM OF AGREEMENT MADE AND ENTERED INTO BY AND BETWEEN THE METROPOLITAN MANILA DEVELOPMENT AUTHORITY AND THE METROPOLITAN BANK AND TRUST COMPANY (METROBANK) AS ITS DEPOSITORY BANK FOR THE COLLECTION OF TRAFFIC FINES AND PENALTIES AS APPROVED BY THE BANGKO SENTRAL NG PILIPINAS MONETARY BOARD
WHEREAS, Republic Act 7924 mandates the MMDA to administer and implement all traffic enforcement operations in Metro Manila;
WHEREAS, the MMDA in carrying out this mandated task, apprehend violators of traffic rules and regulations from time to time;
WHEREAS, in line with the thrust of MMDA to provide better and efficient service to the public particularly to the commuters and motorists, the Agency has made it a policy not to confiscate licenses of erring drivers but instead issue Road Abuser's Payment Order (RAPO) for which payments of traffic fines and penalties may be coursed through a bank in Metro Manila;
WHEREAS, par. h, Subsection 11.2, Section 11, Rule IV of the IRR of Republic Act 7924 empowers the MMDA Chairman "to enter into contracts, memoranda of agreement with the local government units and executive departments and agencies of the national government, POs, NGOs and the private sector for the delivery of required services within Metropolitan Manila";
WHEREAS, on April 19, 2004, the MMDA, represented by the Honorable Chairman Bayani F. Fernando and the Metropolitan Bank and Trust Company represented by Mr. Antonio S. Abacan, Jr. and Mr. Angelito M. Villanueva, entered into a Memorandum of Agreement (MOA) to avail of the bank's services in the collection of traffic fines and penalties in order to facilitate the payment process and at the same time reduce the time and effort exerted by the concerned drivers in redeeming their licenses;
WHEREAS, the Metro Manila Council (Council), in session duly assembled, after due deliberation, considers the aforementioned policy of the Agency as a significant move in promoting effective and efficient public service and for this purpose, recognized the urgent need to ratify the Memorandum of Agreement made and entered into by and between the MMDA and the METROPOLITAN BANK AND TRUST COMPANY to utilize the Bank's services in the collection of traffic fines and penalties.
NOW, THEREFORE, be it resolved as it is hereby resolved, pursuant to Section 6 of RA 7924, that the Council hereby ratifies the Memorandum of Agreement made and entered into by and between the MMDA and the Metropolitan Bank and Trust Company as its depository bank for the collection of traffic fines and penalties as approved by the Bangko Sentral ng Pilipinas Monetary Board.
This Resolution shall take effect upon approval.
