Metro Manila Council

With its 9.93 million inhabitants, Governance poses a very challenging task Solid waste management and flood control are among the mojor concerns that need to be addressed. It is the Metro Manila Council, the policy making body of the MMDA that formulates policies, laws and regulations regarding these.

RA 7924 created the Metropolitan Manila Development Auhtority and further reiterated the powers and functions of the Metro Manila Council as the governing board and policy-making body of the MMDA.

It prescribes and collects service and regulatory fees, and impose and collect fines and penalties. The Council is headed by a Chairman. Its members include voting and non-voting members. The voting members include all the chief executives of the 17 Local Government units of Metro Manila and the Presidents of Vice Mayors League and Councilors League of Metro Manila.

The non-voting members include the department heads of the Department of Tourism, Department of Transportation and Communications, Department of Public Works and Highways, Housing and Urban Development Coordination Counci, and the Philippine National Police.

The Council has 17 Regular Committees in charge of reviewing and recommending the approval of metro-wide programs and projects and formulating policies, rules and regulations in Metro Manila.

The Council holds regular monthly meetings and such special meetings as may be needed as called by the Chairman or of one-third (1/3) of the voting members of the Council.

A quorum - consisting of a majority of the regular members- is necessary to transact the Council's official business. The Chairman presided over the regular or special meeting of the council. In his absence or temporary disability, the voting members of the council, constituting the majority of those present shall elect a temporary presiding officer from among themselves to preside over the meeting.

The council may create Standing Committees shall consider, investigate, hold public hearing or otherwise take action on matters or subjects within the scope of its functions and on other matters referred to it.

A majority vote on any matter, there being a quorum, is sufficient to implement the Councils' acts.

Meanwhile, E.O No. 392 empowered the Metro Manila Council to create the Council Secretariat to extend secretariat and support services which include the preparation of minutes of the meeting, safekeeping of copies of all MMDA ordinances, regulations and resolutions and other pertinent documents involving Council matters; provision of information and indepth policy researches relevant to the legislative activities of the Council, drafts resolutions regulations, review of ordinances or resolutions, preparation of Calendar of Business of the Council and responsible for the efficient administration of a system of registration, diostribution, indexing and monitoring lof all legislative measures filed by the Council and its Committees.

The MMDA Ordinances or Regulations become effective fifteen (15) days from date of publication in two newspapers of general circulation, unless a different date is fixed therein.

All regulations and resolutions affecting the general public are filed with the Office of the National Administrative Register, UP Law Center, pursuant to the Administrative Code of 1987, Administrative Order No. 108, S.1989

The accomplishments of Metro Manila Council are manifested in the resolutions, ordinances and regulations that it has enacted. All these contribute to the development and improvement of Metro Manila as a livable, workable, and humane metropolis.

Since 1990 to September 2007, The Metro Manila Council has passsed 487 resolutions, 50 regulations and 61 ordinances or a total of 598 legislations.

Functions of the Metro Manila Council

 

1. As policy-making body of the Metropolitan Manila Development Authority, the Council shall approve metro-wide plans, programs and projects;

2. It shall issue rules and regulations and resolutions deemed necessary by the MMDA to carry out the plans, programs and projects;3. It may increase the rate of allowances and per diems of the members of the Council to take effect during the term of the succeeding Council;

4. It shall fix the compensation of the officers and personnel of the MMDA, and approve the annual budget thereof for submission to the DBM;

5. It shall promulgate rules and regulations and set policies and standards for metro-wide application governing the delivery of basic services, prescribe and collect service and regulatory fees, and impose and collect fines and penalties.
