URGING THE LOCAL GOVERNMENT UNITS IN METRO MANILA TO IMPLEMENT A 5-YEAR RESETTLETTLEMENT PROGRAM FOR THE INFORMAL SETTLER FAMILIES (ISFs) IN THEIR RESPECTIVE LOCALITIES

WHEREAS, Republic Act No. 7279, otherwise known as the "Urban Development and Housing Act of 1992" declares that it shall be the policy of the state to undertake in cooperation with the private sector, a comprehensive and continuing Urban Development and Housing Program;

WHEREAS, the Local Government Units (LGUs) are mandated to uplift the condition of the underprivileged and homeless citizens in their respective areas and in resettlement areas by making available to them decent housing at affordable cost and providing them basic services and employment opportunities;

WHEREAS, the National Housing Authority (NHA) is the government arm for housing production responsible for the implementation of socialized housing programs under the National Shelter Program, particularly to address the housing needs of the urban poor;

WHEREAS, Republic Act No. 7279, mandated all local government units , in coordination with the National Housing Authority, to implement the relocation and resettlement of persons living in danger areas such as esteros, railroad tracks, garbage dumps, riverbanks, shorelines, waterways, and in other public places such as sidewalks, roads, parks and playgrounds;

WHEREAS, RA 7279 mandated NHA, upon request of LGUs, to provide technical and other forms of assistance in the implementation of their respective urban development and housing programs with the objective of augmenting and enhancing local government capabilities in the provision of housing benefits to their constituents;

NOW THEREFORE, be it resolved as it is hereby resolved, that the LGUs of Metro Manila are hereby urged to develop and implement a 5-year resettlement program for the informal settler families (ISFs) in their respective localities, in partnership with NHA, receiving LGUs, the private sector, civil society and affected ISF communities;

RESOLVED FURTHER, that the LGUs are urged to implement, when feasible, an "In-city Densified Housing Development"

RESOLVED FURTHERMORE, if the resettlement or relocation is under an "Off-City Housing Development" or is pursued outside the LGUs political jurisdiction, the sending and receiving LGUs must enter into an agreement to ensure provision of decent, affordable and adequate housing and basic services to informal settler families subject to relocation using their IRA funds and other sources;

RESOLVED FINALLY, that the LGUs are hereby urged to adhere to the rights-based approach to relocation and resettlement through strict adherence to laws, specifically RA 7279 and its implementing rules and regulations, as amended.
